PRIVACY POLICY

Art. 13 of EU Regulation 2016/679 General Data Protection Regulation

With this policy FLAVIA VALENTINI, as independent data controllers, intend to inform users visiting the website https://flaviavalentini.com/ of the policy adopted regarding the protection of personal data, underlining its commitment and attention with reference to the protection of the privacy of visitors to the Site. Please read carefully our Privacy Policy which applies both in the case of simple navigation within the Site and registration to the same and related services.

Browsing the Site is free and does not require any registration, with the exception of some areas where the User can freely and expressly provide a series of data concerning him/her to access specifically identified services. Where the visitor intends to provide his/her personal data to access these additional services, he/she will be expressly informed pursuant to EU Regulation 2016/679 - General Data Protection Regulation and Legislative Decree no. 196 of 30 June 2003 - Personal Data Protection Code, with an indication (by way of example) of the purposes and methods of use of the data by FLAVIA VALENTINI, as well as the right to request the cancellation of the data or their updating at any time.

We remind Users that personal data means " any information relating to an identified or identifiable natural person "; processing means " any operation or set of operations, performed with or without the aid of automated processes and applied to personal data or sets of personal data, such as collection, recording, organization, structuring, storage, adaptation or modification, extraction, consultation, use, communication by transmission, dissemination or any other form of making available, comparison or interconnection, limitation, erasure or destruction ".

By browsing the Site, the User declares to have read and understood this Privacy Policy.

Information on the processing of personal data

Pursuant to and for the purposes of art. 13 of the Regulation, FLAVIA VALENTINI. provides the following information:

1. Identity and contact details of the Data Controllers

The data controllers of the personal data collected through the Site, each within the limits of the processing actually carried out, are the following:

2. Type of personal data processed

To access the Site, it is not necessary to proceed with any registration. However, there are sections that require registration or the use of a username and password (e.g. to register on the Site), or services for which it is necessary to provide your data (e.g. to contact us, sign up for the newsletter, etc.).

Furthermore, to allow normal and efficient navigation and use of the Site, FLAVIA VALENTINI will collect some personal data of Users relating to the connection and navigation within the Site. With reference to the data relating to navigation within the Site collected through the use of "cookies", see also the following point 10 regarding the Profiling Tools.

Where necessary, the Companies will acquire the User's specific consent to the relevant use of the data.

Here is an example of the type of information that is collected through the Site:

√ Interest and preference data: data relating to your purchases (e.g. number, value and types of purchases), products placed in the shopping cart, etc.;

√ Transactional data: credit card number, tax code, VAT, etc.;

3. Optional provision of personal data

Some of the personal data requested on the Site, such as name and surname, telephone number and e-mail address, may be marked as "mandatory" [for example, indicated with an (*)] as they are necessary to access the services of the Site that you wish to use (for example, if you place an order). Failure to provide data marked as "mandatory" will make it impossible for the Companies to provide the requested service (for example, if the User does not provide his/her e-mail address, FLAVIA VALENTINI will not be able to proceed with sending the newsletter). Failure to provide data marked as "optional" will have no consequences.

Users are required to indicate on the Site only the personal data that concern them. If personal data of third parties are indicated, Users must expressly declare and acknowledge that they have obtained the consent of third parties for the processing of the corresponding personal data by the Companies, or other data controllers.

4. Purpose and legal basis of the processing

User data is collected and processed for purposes strictly connected to the use, management and updating of the Site, the services offered within it and its presentation to Users. The specific purposes of use of the data are indicated in detail in this paragraph.

(a) Registration on the Site

The Users' personal data will be processed by FLAVIA VALENTINI to allow registration on the Site, proceed with the creation of a personal account and guarantee access to the areas and any benefits reserved for members (e.g. make purchases more quickly, check purchase history, etc.).

The Users' email address may also be used to send any communications relating to the methods of using the Site's features (e.g. confirmation of registration, invitation to renew credentials, etc.).

The processing of data for this purpose does not require the consent of the Users, as it is necessary for the execution of a contract between the Users and FLAVIA VALENTINI (art. 6, paragraph 1, letter b) of the Regulation).

(b) E-commerce

If the User makes a purchase on the Site, his/her personal data will be processed by FLAVIA VALENTINI for

complete the sales process and execute the contract in place between the parties (e.g. management and processing of payment, completion of the delivery and/or return process, etc.);

fulfill legal obligations (e.g. in tax matters, accounting for invoicing, bookkeeping and accounting records) relating to the contract concluded with the User;

manage any services strictly connected to the sale (e.g. request for information regarding the products, use of customer service, sending the order confirmation, etc.);

protect the rights arising from the contract concluded with the User, also through agents, in court or out of court.

The processing of data for this purpose does not require the consent of the Users, as it is necessary for the execution of the sales contract concluded with the User and for the execution of pre-contractual measures adopted at the request of the User, as well as to correctly fulfill the legal obligations to which FLAVIA VALENTINI is subject (art. 6, paragraph 1, letters b) and c) of the Regulation) and - in the event of disputes - for the pursuit of the legitimate interest of the Company in the protection of its rights (art. 6, paragraph 1, letter f) of the Regulation).

(c) Contact us

The data provided by filling out the "Contact Us" form or using the contact services (via email, telephone or post) will be processed by FLAVIA VALENTINI to respond appropriately to reports and/or requests for information from Users.

The processing of data for this purpose does not require the consent of the Users, as it is necessary for the execution of the sales contract concluded with the User or for the execution of pre-contractual measures adopted at the request of the User (art. 6, paragraph 1, letter b) of the Regulation).

Furthermore, after obtaining suitable and specific consent, User data will be processed for:

Allow registration for the update service on promotions, sales and initiatives - through the use of automated and non-automated means, such as newsletters, e-mails, telephone contact, text messages, instant messages, posts, communications and posts on social networks, etc. -, relating to the "FLAVIA VALENTINI" brand.

In case of subscription to the "Newsletter", the User will only receive commercial communications to the email address indicated during registration.

Where the User has consented to the analysis of preferences, communications may be personalized on the basis of interests and additional information available relating to the individual User (for example, indicating only the promotions active in the region to which the interested party belongs).

The processing of data for this purpose requires the consent of the Users (art. 6, paragraph 1, letter b) of the Regulation).

(e) Preference analysis

Analyze your data (including, where available, your browsing data) to understand the purchasing preferences and tastes of Users and allow us to consequently improve our commercial offering and personalize communications.

The processing of data for this purpose requires the consent of the Users (art. 6, paragraph 1, letter b) of the Regulation).

It is understood that failure to provide consent for purposes (d), (e) and (f) will in no way affect the possibility of registering on the Site, making a purchase or contacting the Companies for any type of complaint or information.

We remind Users that any consent provided may be revoked at any time (i) by accessing their personal area on the Site and changing the relevant settings, (ii) (with regard to Newsletters) by clicking on the appropriate link present in all communications; (iii) by contacting customer service by sending a specific communication to the address info@flaviavalentini.com In the event of revocation of consent relating to the update service, the User will no longer receive any type of communication, in any manner. It is always possible to revoke consent limited to the receipt of communications via electronic means (e.g. e-mail, text message, telephone call, instant messages), continuing to receive commercial communications only via paper mail or telephone contact with an operator.

5. Methods of treatment

The processing of Users' personal data occurs through archiving on electronic media, in compliance with current legislation and, in any case, in a way to guarantee the security and confidentiality of the data and prevent unauthorized disclosure or use, alteration or destruction. All information collected is transmitted in a protected connection in order to prevent interception by outsiders.

If the User consents to the processing for analysis purposes, FLAVIA VALENTINI will use the data collected (e.g. age and data of origin) to examine the interests and preferences of the interested party, in order to improve its offer and personalize its communications. All data and preference analysis activities will not take place with exclusively automated methods, but will always involve the intervention and evaluation of natural persons duly authorized to do so.

6. Recipients of personal data

The Users' data will be disclosed (limited to their respective areas of competence) to personnel expressly authorised by the Companies, pursuant to art. 29 of the Regulation.

Within the scope of the purposes indicated in the table below, the personal data of Users may be disclosed to the following third parties:

(c) (i) the company responsible for managing the company information systems; (ii) the companies that provide services instrumental to the management of the contractual relationship (e.g. suppliers of the e-commerce platform); (iii) the FLAVIA VALENTINI companies, which provide accounting, administrative, tax and management control services.

(d) (i) the company in charge of managing the company information systems; (ii) the company FLAVIA VALENTINI, which provides the services connected to the management of the Site; (iii) the companies that provide services instrumental to the marketing activity (e.g. suppliers of platforms for sending commercial communications) and analysis (e.g. suppliers of dedicated software).

(e) Email addresses may also be temporarily communicated - in encrypted and protected form - to social networks (e.g. Facebook, Instagram, etc.) to allow Users registered on social networks to view news or advertising relating to the "FLAVIA VALENTINI" brand.

(f) (i) the company in charge of managing the company information systems; (ii) the companies that provide services instrumental to the functioning of the "Store Locator" functionality (e.g. suppliers of geolocation cookies, such as Web Geo Services).

Where necessary, the Companies have appointed the recipients of the Users' personal data as data controllers, pursuant to art. 28 of the Regulation. A list of all data controllers may be requested by sending a communication to the addresses indicated in this Privacy Policy.

The personal data of the Users will never be disclosed.

7. Transfers outside the EU:

To allow for correct and efficient management of the Site, Users' personal data may be transferred to countries outside the European Union, including the USA.

The transfer of data will take place in full compliance with the guarantees, measures and rights provided for by privacy legislation. By simple request, the User may receive more information on the transfer of his data and on the guarantees provided for their protection.

8. Retention period

User data will be retained for the time strictly necessary to pursue the purposes indicated in point 4 of the Privacy Policy and in compliance with any consents provided. At the end of the retention period, the data will be destroyed or made anonymous.

Specifically, the data will be stored according to the criteria indicated in the following table.

Purpose of Conservation

(a) The data will be retained for the entire duration of the registration on the Site. After a period of 5 years of total inactivity of the account, the data will be deleted.

(b) The data will be retained for the time necessary to manage and complete the sales process, and subsequently in compliance with the legal obligations connected to the contractual relationship. In any case, the personal data of the Users will not be retained for a period exceeding 10 years from the termination of the contractual relationship (except for any further retention in the event of a dispute relating to the contract between the parties).

(c) The data will be stored for the time necessary to correctly manage the User's report and/or request. In any case, the Users' personal data will not be stored for a period exceeding 5 years from the request for information.

(d) The data will be processed for the entire duration of the subscription to the update and/or newsletter service, in full compliance with the consents provided by the User, without prejudice to the possibility of revoking the consent at any time.

(e) In particular, data relating to the details of Users' purchases may be processed for marketing or analysis purposes for a maximum period of 48 and 36 months respectively from their registration.

9. Links to other sites

This Privacy Policy is provided only for the site www.flaviavalentini.com and not for other websites that may be consulted by the User via connection links. The Companies cannot be held responsible for personal data provided by Users to external parties or to any websites connected to this Site.

10. "Profiling" and/or personalization tools

does not carry out any promotional and/or advertising communication activity without the prior express consent of the User.

The Site uses "cookies", both technical (i.e. to facilitate navigation and use of the Site) and profiling (i.e. to analyse Users and their behaviour and preferences, and to provide them with personalised advertising).

11. Rights of interested parties

By contacting FLAVIA VALENTINI customer service or sending a communication to info@flaviavalentini.com , the User may at any time exercise - towards FLAVIA VALENTINI - the rights set out in articles 15 to 22 of the Regulation, including knowing which data we are processing, with which methods and for which purposes we use them, modifying the data you have provided us or deleting them, asking us to limit the use of the data, requesting to receive or transmit the data, without prejudice to the possibility of revoking and/or modifying any consent to the processing provided.

Furthermore, the User may always oppose the processing of his/her data for marketing purposes or analysis of preferences.

In the event of exercising one of the rights provided for by the Regulation, the Owner reserves the right to verify the identity of the User by requesting to send a photocopy of an identity document that certifies the legitimacy of the request. Once the identity has been confirmed, the photocopy received will be immediately destroyed.

12. Complaint to the Supervisory Authority

If a User believes that the processing of his/her data violates the provisions of the Regulation, he/she may always lodge a complaint with the Data Protection Authority (www.garanteprivacy.it), or with the Data Protection Authority of the country in which he/she habitually resides, works or where the alleged violation occurred.

13. Review clause

The Companies reserve the right to review, modify or simply update, in whole or in part, at their sole discretion, in any way and/or at any time, without notice, this Privacy Policy, also in consideration of changes in laws or regulations regarding the protection of personal data. Changes and updates to the Privacy Policy will be notified to Users as soon as they are adopted and will be binding as soon as they are published on the Site. We therefore ask Users to regularly access the "Privacy" section of the Site to verify the publication of the most recent and updated Privacy Policy.
