CONDITIONS OF SALE

The online sales system, which presupposes active intervention by the Customer, was created in full compliance with the legislation on distance selling and in particular with the articles. 49 et seq. of the Consumer Code (Legislative Decree no. 206 of 6 September 2005 and subsequent amendments and additions). The use of the distance selling process described in these general conditions of sale is reserved exclusively for consumers as defined by the art. 3 of Legislative Decree 206 of 6 September 2005 and only if the products are delivered in Italian territory (hereinafter defined for brevity as the "Customer" or "Customers").

1. Scope

These general conditions of sale are applicable to all sales of Flavia Valentini products, concluded remotely through the flaviavalentini.com website. These general conditions of distance selling must be carefully examined by the Customer before completing the distance purchasing procedure of the product indicated above. To make any changes and/or corrections to the order, the Customer must follow the relevant instructions contained on the Site.

The order through this website can be placed by the Customer who guarantees that he or she is of age (18 years or older) and has the legal faculty to enter into binding contracts.

The amount of the single order cannot exceed the sum of Euro 10,000 in total.

The order will be sent by clicking the "Buy now" button and will be archived in Flavia Valentini's order storage database for the period of time required by current legislation.

The order will therefore be considered a contractual purchase proposal. Upon receipt of the order, Flavia Valentini will send the Customer an email containing the order number and information about the products ordered, the details of the price of each product, the shipping address as well as the payment methods and approximate delivery times. This email does not constitute acceptance of the Customer's purchase proposal, but only constitutes confirmation of having received the order. Once the Customer's order has been received, Flavia Valentini will check the availability of the products ordered as well as the correctness of the information provided by the Customer.

The sales contract with Flavia Valentini will be concluded only with the sending of a separate email accepting the purchase proposal and/or confirming the shipment of the ordered products.

The Customer's order may be rejected in the event that the information provided by the customer is incorrect or does not comply with these general conditions, in the event of exhaustion of available products, in the event that insufficient guarantees of solvency are found, if the order does not corresponds to normal consumption needs (requirement that applies both in relation to the number of products purchased within a single order and in the case of a plurality of orders relating to the same product, even if each order includes a quantity of products corresponding to normal consumption needs), or for reasons of force majeure.

5. Product price

The price of the product published on the site refers to the single item, expressed in Euros and inclusive of VAT. Flavia Valentini will take charge of the payment of all taxes, duties, charges and/or shipping costs in Italy and Europe.

6. Payment conditions

Payment by the Customer can be made by credit card, active PayPal account or Klarna. The following credit cards are accepted:

- Mastercard;

- American Express;

- Maestro International

Payment can also be made via Gift Card.

The total amount of the order is committed to the Customer's credit card or PayPal account when the order is forwarded to Flavia Valentini (when the Customer selects "Buy now"), with simultaneous acceptance by Flavia Valentini, pursuant to art. 4, and activation of the preparation of the products for shipping. In order to prevent fraud on the Internet, the payment made through the flaviavalentini.com website is managed online by the bank that manages the Customer's credit card, through the tools offered by Axerve and PayPal. Axerve, PayPal and their respective affiliated companies are responsible for storing and automatically processing in a protected environment the information relating to each order, including the details of the credit card used.

For payment purposes, the Customer must:

- in case of payment by credit card, confirm the details of the holder of the credit card used for the purchase via the flaviavalentini.com website; then communicate the 16-digit number and expiry date, as well as the related security code, on the site itself;

- in case of payment via PayPal account, enter your login details in the appropriate space on the PayPal page to which you will be automatically redirected, and then complete the payment in the manner indicated by the service administrator.

It is possible to revoke the aforementioned authorization at any time from within your My Account account, or by making an express request to Customer Service (customerservice@flaviavalentini.com), or directly from the Customer's PayPal account. PayPal may require the Customer to re-enter their login credentials if there is suspicion of unauthorized activity linked to the use of the PayPal account.

The conclusion of the order procedure will be considered to have taken place effectively, following the completion of the payment operations, once the Customer is redirected to the page of the flaviavalentini.com website containing confirmation of acceptance of the order.

In the event that the debit proves impossible due to incorrect typing of data by the Customer or for other technical reasons that will be communicated to the Customer by the payment service administrator, the Customer will not be able to complete the "Buy now" procedure ; if the Customer decides to abandon the payment page according to the methods indicated by the service administrator, he will be redirected to a page on the flaviavalentini.com website which will display the impossibility of completing the order.

7. Delivery

Before making the purchase, the Customer can alternatively choose one of the following delivery methods.

7.1 Delivery to the Customer's address.

The Customer does not have the possibility to request delivery of the products to post office boxes, sorting centers and/or similar. In compliance with the provision contained in the art. 61 of the Consumer Code, Flavia Valentini will deliver the products no later than 30 days from the day on which the Customer sent the order. In the event of unavailability of the recipient, or of another person authorized to receive the shipment at the time of the delivery attempt, the express courier will make a further delivery attempt the following day, in the event that the second attempt is also unsuccessful , the express courier will issue a paper notice containing their contact details and the collection point where it will be possible to collect the products. If the Customer does not collect the products from the collection point within 10 days, the ordered products will be returned to the warehouse. Customer Service will contact the Customer to agree whether to proceed with a new shipment of the ordered products or whether to refund the relevant payment.

In the further case in which the delivery of the product(s) to the Customer does not take place within 4 working days following the shipping date, as simultaneously communicated to the Customer by Flavia Valentini, and the impossibility of tracing the location has occurred where the goods are located via the online system that will be made available to the Customer, the Customer must notify Flavia Valentini of the non-delivery of the product(s) via the "Contacts" page.

Flavia Valentini undertakes to guarantee a new shipment of the lost product(s) within 48 (forty-eight) hours following the notification, without prejudice to the subsequent unavailability of the same or causes of force majeure, in which case the cancellation of the order will follow. the order and the simultaneous refund of the amount reserved for payment.

7.2 Delivery to the selected point of sale

The Customer does not have the possibility to request delivery of the products to post office boxes, sorting centers and/or similar. In compliance with the provision contained in the art. 61 of the Consumer Code, Flavia Valentini will deliver the products, making them available to the Customer at the point of sale selected by the same, no later than 30 days from the day on which the Customer sent the order.

If the Customer does not collect the products from the selected point of sale within 15 days, starting from the day on which he received the communication of the availability of the products at the selected point of sale, the ordered products will be returned to the warehouse.

8. Shipping costs

Delivery is free for Italy and Europe on all items purchased on flaviavalentini.com.

9. Right of withdrawal

The Customer may exercise the right of withdrawal provided for in Article 52 of the Consumer Code within 14 (fourteen) calendar days from the day on which the Customer or a third party, other than the carrier and designated by the Customer, acquires physical possession of the goods. .

Note: SALE items are not eligible for returns.

The Customer may exercise his right of withdrawal, without indicating the reasons:

  1. by email, to the account, customerservice@flaviavalentini.com, if necessary together with the purchased goods, in perfect condition in their original packaging, with the label and all the documentation received .

The Customer must therefore, no later than 14 (fourteen) calendar days following the withdrawal request referred to above, return the products in the same conditions in which they were at the time of delivery following the methods indicated in the following articles. 10.1 or 10.2 and the related return costs will be borne by Flavia Valentinie.

In the event that the exercise of the right of withdrawal satisfies the above conditions, the reimbursement of the value of the returned products, equivalent to their purchase price, will take place by crediting the amount paid by the Customer within 14 (fourteen) calendar days, starting from the date on which Flavia Valentini became aware of the withdrawal request.

Flavia Valentini may withhold the refund until she has received the goods.

In case of payment made by credit card or PayPal account, Flavia Valentini will make this refund using the same payment method used by the Customer/consumer for the initial transaction, unless express agreement with the Customer/consumer on another means of payment and on condition that this does not result in additional costs for the consumer.

When requesting a return, the customer must indicate his/her name on the site account or agree directly with Customer Service on the day and time slots in which the courier can collect. The collection of the return must take place no later than 14 days from the exercise of the right of withdrawal referred to in the previous art. 9.

Following the aforementioned return request, the Customer will receive an email confirming that the return has been accepted, containing the label with the collection number to be applied to the package that will be collected.

The Flavia Valentini return procedure can only be activated from Italy.

If the Customer does not intend to use the Flavia Valentini return procedure, the products must be returned within 14 days of exercising the right of withdrawal to Customer care Flavia Valentini.

10.4 Conditions of integrity for returns

According to the provisions of article 57 of the Consumer Code, the consumer is responsible if the products returned by the Customer are damaged, incomplete, deteriorated and/or used in a manner that does not comply with normal diligence. In the event of returning the item damaged, incomplete, deteriorated and/or in conditions of use that do not comply with normal diligence, without prejudice to the right of withdrawal, the Customer will be charged the sum corresponding to the decrease in value of the item. In such cases, Flavia Valentini will promptly notify the Customer of the damages and non-conformities found upon receipt of the items. The sum charged to the Customer, which in any case cannot be higher than the price paid for the purchase of the item, will be deducted from the refund due to the Customer.

Returns of products originating from unidentifiable subjects and without references to the order will remain in storage at Flavia Valentini's warehouses for a period of 60 days from receipt of the goods, after which, without the subject having identified himself, Flavia Valentini will be able to dispose of it freely.

10.5 Items not ordered, damaged or different from the order

Flavia Valentini is consequently not responsible for any inadequacy of the photographic representations of the products due to the aforementioned technical reasons. In such cases, the Customer will only be able to return the product within the withdrawal period referred to in the art. 9.

In case of receiving a product different from the one ordered, the Customer will be able to return the product within the withdrawal period referred to in the art. 9.

10.6 Replacement of products

The purchased products can be replaced, upon request of the Customer, no later than 14 days from receipt of the ordered products, with others of the same model, changing size and/or colour, according to the same return procedures indicated in the previous articles. 10.1. and 10.2.

The Customer may also exercise the right of withdrawal on replaced products, following the same procedures indicated.

The replacement cannot therefore take place at the points of sale, but only through the flaviavalentini.com website, following the methods of requesting and returning the products indicated therein.

11. Compliance – Guarantee

2. 14. Force majeure

The execution of services by the Flavia Valentini company may be suspended in the event of the occurrence of a fortuitous event or force majeure which prevents or delays their execution. Events independent of the will of Flavia Valentini, which the latter could not reasonably have expected at the time of the conclusion of the sales contract, are considered as such, such as, for example, but without limitation, war, riots, insurrections, strikes and supply problems of the Flavia Valentini company attributable to third party suppliers. The Flavia Valentini company will inform the Customer of the occurrence of unforeseeable circumstances or force majeure within 7 (seven) days of the occurrence of the same. 15. Applicable law and competent court

These general conditions of sale are governed by Italian law.

In the event of disputes concerning these general conditions of sale, the Customer is informed of the possibility of using the ODR platform relating to the resolution of online consumer disputes pursuant to EU Regulation 524/2013 and Legislative Decree. 130/2015 adopted in implementation of EU Directive 2013/11. However, the Customer has the right to take ordinary action to resolve disputes arising from the interpretation, validity and/or execution of these general conditions of sale and in this case the mandatory territorial jurisdiction will be that of the local judge. of residence or domicile of the consumer.
