TERMS OF SALE
The online sales system, which requires active intervention by the Customer, has been created in full compliance with the regulations on distance selling and in particular with articles 49 et seq. of the Consumer Code (Legislative Decree no. 206 of 6 September 2005 and subsequent amendments and additions). The use of the distance selling process described in these general conditions of sale is reserved exclusively for consumers as defined by art. 3 of Legislative Decree 206 of 6 September 2005 and only if the products are delivered in Italy (hereinafter referred to for brevity as the "Customer" or "Customers").
1. Scope of application
These general conditions of sale are applicable to all sales of Flavia Valentini products, concluded remotely through the website flaviavalentini.com. These general conditions of remote sale must be carefully examined by the Customer before completing the remote purchase procedure of the product indicated above. It is understood that placing a purchase order through the website flaviavalentini.com implies total and absolute knowledge of these general conditions of sale and their full acceptance: the Customer, by placing a purchase order through the website flaviavalentini.com, unconditionally accepts and undertakes to observe, in his relations with Flavia Valentini, these general conditions of sale, as well as the payment conditions illustrated below, declaring that he has read and accepted all the indications provided to him. Any exceptions to these general conditions will be effective only if agreed in writing between the parties. These general conditions of sale are to be considered applicable and in force as long as they are published on the website flaviavalentini.com. Any changes to these general conditions of sale will be published on the site and the new general conditions of sale will be applicable exclusively to orders placed starting from the day of their publication.

3. Product information
The information relating to Flavia Valentini products susceptible to distance selling through the flaviavalentini.com website is provided in compliance with the laws in force and, in particular, with articles 49 and 51 of the Consumer Code.
4. Ordering the product and conclusion of the contract
The presentation of the products on the site constitutes an invitation to offer
The order can be placed through the website flaviavalentini.com, selecting any image of the product presented therein and in any case following the steps and instructions specified on the site itself. To make any changes and/or corrections to the order, the Customer must follow the relevant instructions contained on the Site.
The order through this website can be placed by the Customer who guarantees to be of legal age (18 years and over) and to possess the legal capacity to enter into binding contracts.
The amount of a single order cannot exceed a total of Euro 10,000.
The order will be sent by clicking the “Buy Now” button and will be stored in the Flavia Valentini order storage database for the period of time required by current legislation.
The order will therefore be considered a contractual purchase proposal. Upon receipt of the order, Flavia Valentini will send the Customer an email containing the order number and information about the products ordered, the price details of each product, the shipping address, as well as the payment methods and the indicative delivery times. This email does not constitute acceptance of the Customer's purchase proposal, but only constitutes confirmation of having received the order. Upon receipt of the Customer's order, Flavia Valentini will verify the availability of the products ordered as well as the correctness of the information provided by the Customer.
The sales contract with Flavia Valentini will be concluded only with the sending of a separate email of acceptance of the purchase proposal and/or confirmation of shipment of the products ordered.
The Customer's order may be rejected if the information provided by the customer is incorrect or does not comply with these general conditions, if the available products are no longer available, if insufficient guarantees of solvency are found, if the order does not correspond to normal consumption needs (a requirement that applies both in relation to the number of products purchased within a single order and in the case of multiple orders relating to the same product, even if each order includes a quantity of products corresponding to normal consumption needs), or for reasons of force majeure.
If the order cannot be accepted, Flavia Valentini will communicate within 10 days following receipt of the order, the possible impossibility of fulfilling the order itself, which will be followed by the immediate release of the amount reserved for payment.
5. Product price
The price of the product published on the site is for a single item, expressed in Euros and inclusive of VAT. Flavia Valentini will take charge of the payment of all taxes, duties, charges and/or shipping costs in Italy and Europe.
6. Payment Terms
Payment by the Customer can be made by credit card, active PayPal account or Klarna. The following credit cards are accepted:
- Visa/Visa Electron;
- Mastercard;
- American Express;
- Maestro International
Payment can also be made via Gift Card.
The total amount of the order is committed to the credit card or PayPal account of the Customer at the time of forwarding the order to Flavia Valentini (when the Customer selects "Buy now"), with simultaneous acceptance by Flavia Valentini, pursuant to art. 4, and activation of the preparation of the products for shipping. In order to prevent fraud on the Internet, the payment made through the flaviavalentini.com site is managed online by the bank that manages the Customer's credit card, through the tools offered by Axerve and PayPal. Axerve, PayPal and their respective affiliates are responsible for the storage and automatic processing in a protected environment of the information relating to each order, including the details of the credit card used.
For payment purposes, the Customer must:
- in case of payment by credit card, confirm through the website flaviavalentini.com the data of the holder of the credit card used for the purchase; then communicate on the website itself the 16-digit number and the expiry date, as well as the relative security code;
- in case of payment via PayPal account, enter the access details in the appropriate space on the PayPal page to which you will be automatically redirected, and then complete the payment in the manner indicated by the service provider.
- if paying by gift card, enter the 16-digit number on the back of the card, or in the email if purchasing online.
During the purchase, Flavia Valentini will store a recognition code associated with the Customer's PayPal account, which authorizes its exclusive use for future purchases, or replacements of goods already purchased, in order to avoid having to enter your PayPal access data again.
You may revoke the above authorization at any time from within your My Account account, or by making an express request to Customer Service (customerservice@flaviavalentini.com), or directly from the Customer's PayPal account. PayPal may require the Customer to re-enter their login credentials, if there is a suspicion of unauthorized activity related to the use of the PayPal account.
The conclusion of the order procedure will be considered to have effectively taken place, following the completion of the payment operations, once the Customer is redirected to the page of the flaviavalentini.com website containing confirmation of acceptance of the order.
In the event that the charge is impossible due to incorrect data entry by the Customer or other technical causes that will be communicated to the Customer by the payment service provider, the Customer will not be able to complete the "Buy now" procedure; if the Customer decides to abandon the payment page according to the methods indicated by the service provider, he/she will be redirected to a page on the flaviavalentini.com website that will display the impossibility of completing the order.
7. Delivery
Before making the purchase the Customer can alternatively choose one of the following delivery methods.
7.1 Delivery to the Customer's address.
The delivery of the products is carried out, to the address indicated by the Customer, only after the regular payment of the order forwarded to Flavia Valentini. The Customer does not have the possibility to request delivery of the products to PO boxes, sorting centers and/or similar. In compliance with the provision contained in art. 61 of the Consumer Code, Flavia Valentini will carry out the delivery of the products within and no later than 15 days from the day on which the Customer sent the order. In the event that the recipient, or another person authorized to receive the shipment is unavailable at the time of the delivery attempt, the express courier will make a further delivery attempt the following day, in the event that the second attempt is also unsuccessful, the express courier will issue a paper notice containing its contact details and the collection point where it will be possible to collect the products. If the Customer does not collect the products from the collection point within 10 days, the ordered products will be returned to the warehouse. Customer Service will contact the Customer to agree whether to proceed with a new shipment of the products ordered or to refund the relative payment.
In the further event that the delivery of the product(s) to the Customer does not take place within 4 working days following the shipping date, as communicated to the Customer by Flavia Valentini, and it is impossible to trace the location of the goods using the online system that will be made available to the Customer, the Customer must communicate to Flavia Valentini the non-delivery of the product(s), via the "Contacts" page.
Flavia Valentini undertakes to guarantee a new shipment of the lost product(s) within 48 (forty-eight) hours following the notification, except in the event of subsequent unavailability of the same or causes of force majeure, in which case the order will be cancelled and the amount reserved for payment will be refunded.
8. Shipping costs
Delivery is free for Italy and Europe on all items purchased on flaviavalentini.com.
9. Right of withdrawal
The Customer may exercise the right of withdrawal provided for by Article 52 of the Consumer Code within 14 (fourteen) calendar days from the day on which the Customer or a third party, other than the carrier and designated by the Customer, acquires physical possession of the goods.
Please note: SALE items are not eligible for returns.
The Customer may exercise his right of withdrawal, without indicating the reasons:
  1. by email, to the account, customerservice@flaviavalentini.com, if necessary together with the purchased goods, in perfect condition in their original packaging, with the label and all the documentation received .
The Customer must therefore, within and no later than 14 (fourteen) calendar days following the request for withdrawal above, return the products in the same conditions in which they were at the time of delivery following the methods indicated in the following art. 10.1 or 10.2 and the related return costs will be borne by Flavia Valentini.
In the event that the exercise of the right of withdrawal satisfies the conditions set out above, the refund of the value of the returned products, equivalent to their purchase price, will take place by crediting the amount paid by the Customer within 14 (fourteen) calendar days from receipt of the return.
In the event of payment made by credit card or PayPal account, Flavia Valentini will carry out such refund using the same means of payment used by the Customer/consumer for the initial transaction, unless expressly agreed with the Customer/consumer on another means of payment and provided that this does not result in additional costs for the consumer.
When requesting a return, the customer must indicate on the site via their account or agree directly with Customer Service the day and time slots in which the courier can collect the goods. The return must be collected no later than 14 days after exercising the right of withdrawal referred to in the previous art. 9.
Following the aforementioned return request, the Customer will receive an email confirming that the return has been received, containing the label with the collection number to be applied to the package that will be collected.
If the Customer does not intend to avail of the Flavia Valentini return procedure, the products must be returned within 14 days of exercising the right of withdrawal to Customer care Flavia Valentini.

The direct costs of return will be borne by the Customer.
10.4 Integrity conditions for the return
According to Article 57 of the Consumer Code, the consumer is responsible if the products returned by the Customer are damaged, incomplete, deteriorated and/or used in a manner not compliant with normal diligence. A good is considered to be used beyond normal diligence in the case of use beyond what is necessary to establish its nature, characteristics and functioning (e.g. in the case of removal of labels, in the case in which the item has been worn and not merely tried on).
It is possible to return an item purchased on flaviavalentini.com only if in the same condition in which it was received. The Customer must therefore ensure that:
- the item has not been used or damaged during testing;
- the item has not been soiled or washed;
- the item retains all the charms, labels, the guarantee seal placed on the item during quality control and the original finishing;
- the article has not undergone any changes of any kind.
In particular, we specify that all types of items contained in their original box must be returned in the original packaging, which is considered an integral part of the item.
In the event of a damaged, incomplete, deteriorated and/or used item being returned in conditions that do not comply with normal diligence, without prejudice to the right of withdrawal, the Customer will be charged the amount corresponding to the decrease in value of the item. In such cases, Flavia Valentini will promptly notify the Customer of the damage and non-conformities found upon receipt of the items. The amount charged to the Customer, which in any case cannot exceed the price paid for the purchase of the item, will be deducted from the refund due to the Customer.
For any doubts, please contact our Customer Service, and in case of doubts regarding the shipment and/or delivery of the order, you can also contact customer support.
Returns of products from unidentifiable subjects and without references to the order will remain in storage at Flavia Valentini's warehouses for a period of 60 days from receipt of the goods, after which, without the subject having identified himself, Flavia Valentini will be able to dispose of them freely.
10.5 Items not ordered, damaged or different from the order
We would like to inform our Customers that flaviavalentini.com subjects its garments and the materials they are made of to strict quality controls, guaranteeing that they are marketed in perfect conditions. In addition, for greater protection of those who make remote purchases, each individual garment shipped by flaviavalentini.com is checked before shipping.
Flaviavalentini.com adopts the best photographic standards, so that on the site, the color rendering of the garments is as close as possible to how they appear in real life. Possible variations are not excluded due to the technical characteristics and color resolution of the Customer's computer.
Flavia Valentini is consequently not responsible for any inadequacy of the photographic representations of the products due to the aforementioned technical reasons. In such cases, the Customer may only return the product within the terms of the withdrawal period referred to in art. 9.
In case of receiving a product different from the one ordered, the Customer may return the product within the withdrawal period referred to in art. 9.
10.6 Replacement of products
The purchased products can be replaced, upon request of the Customer, within and no later than 14 days from receipt of the ordered products, with others of the same model, changing size and/or color, according to the same return procedures indicated in the previous articles 10.1. and 10.2.
The Customer may also exercise the right of withdrawal on replaced products, following the same procedures indicated.
The replacement cannot therefore take place at the points of sale, but only through the website flaviavalentini.com, following the request and product return procedures indicated therein.
11. Conformity – Warranty
1. Any complaints for non-conformity must be communicated in good time to Flavia Valentini with a description of the non-conformity.
2. In the event of receiving a non-compliant product or a product different from that ordered, the Customer must make the product in question available to Flavia Valentini, and the same must have the numbered guarantee seal intact and unremoved as placed on the item at the time of the quality control prior to shipment.
3. In the cases provided for by the Consumer Code, the Customer may choose between the resolution of the purchase and the reduction of the price. Such remedies in the event of delivery of a plurality of products apply only to the non-compliant product unless it is presumed that the consumer purchaser has an interest in keeping only the compliant products.
12. Complaints - Communications - Information
For any information or complaint, or for any communication relating to these general conditions of sale, orders and/or Flavia Valentini products, the Customer can contact Customer Service via the “Contacts” link in the Customer Service section on the flaviavalentini.com website.
1. The Customer may contact Customer Service free of charge via email by filling out the appropriate form, or by calling the telephone number indicated, active from Monday to Friday.
Please note that, should the Customer decide to use any other channel or form of communication (for example: ordinary mail, fax, calls to a pay telephone number in any case attributable to Jolie Concierge di Flavia Valentini) other than those described above, Jolie Concierge di Flavia Valentini will not be required in any case to reimburse any expenses incurred by the Customer for the use of this means of communication.
13. Provisions on privacy and personal data protection
The collection and processing of data are carried out for the management and execution of current and future purchase orders and in particular for the execution of the obligations arising from these General Conditions of Sale.
14. Force majeure
The performance of the services by the company Flavia Valentini may be suspended in the event of the occurrence of a fortuitous event or force majeure that prevents or delays the performance. Events that are independent of the will of Flavia Valentini, which the latter could not reasonably expect at the time of the conclusion of the sales contract, are considered as such, such as, for example, but not limited to, war, riots, insurrections, strikes and supply problems of the company Flavia Valentini attributable to third-party suppliers. The company Flavia Valentini will inform the Customer of the occurrence of the fortuitous event or force majeure within 7 (seven) days of its occurrence. In the event that the suspension of the service should extend for a period exceeding 15 days, the Customer will have the possibility of canceling the order placed and will be reimbursed for the amounts already paid.
15. Applicable law and competent court
These general conditions of sale are governed by Italian law.
In the event of disputes concerning these general conditions of sale, the Customer is informed of the possibility of using the ODR platform relating to the resolution of online consumer disputes pursuant to EU Regulation 524/2013 and Legislative Decree 130/2015 adopted in implementation of EU Directive 2013/11. This platform is active at the following web address https://webgate.ec.europa.eu/odr/main/?event=main.home.show&lng=IT.
In any case, the Customer retains the right to take ordinary action to resolve disputes arising from the interpretation, validity and/or execution of these general conditions of sale and in this case the mandatory territorial jurisdiction will be that of the judge of the place of residence or domicile of the consumer.
